The anticipated plea deal of Hunter Biden unraveled, resulting in his plea of not guilty.
Federal Judge Maryellen Noreika derailed the expected plea deal for Hunter Biden, son of President Joe Biden, to plead guilty to two federal tax misdemeanors. Her concerns revolved around the “broad” immunity granted by prosecutors in the deal and its “unique” structure.
During the lengthy court hearing, Hunter Biden ultimately entered a plea of not guilty after Judge Noreika deferred his attempts to plead guilty. She expressed reservations about the potential unconstitutionality and lack of legal precedent in the plea deal.
In response, Judge Noreika ordered defense attorneys and federal prosecutors to provide additional justifications for the legal legitimacy of both the plea deal and a separate agreement aimed at dismissing a weapons felony. The parties were also required to clarify the language that could grant Hunter Biden immunity for potential future prosecution related to his foreign investments and consulting work, which have earned him substantial income over the past decade.
The charges against Hunter Biden stemmed from willfully avoiding tax payment on more than $1.5 million in income in 2017 and 2018. Prosecutors detailed that he received $2.4 million in income in 2017 and $2.1 million in 2018, coming from sources like Ukrainian energy firm Burisma, a Chinese-development firm, domestic business interests, and legal services.
Hunter Biden faced an additional weapons charge for falsely stating he was not addicted to illicit substances on a federal form when purchasing a gun in Delaware in 2018. The U.S. Attorney for Delaware, David Weiss, had led the criminal investigation into Hunter Biden’s finances over the past five years.
Before the hearing, it was expected that Hunter Biden would plead guilty to the two misdemeanor tax crimes, with prosecutors recommending probation as the sentence, each carrying a maximum of one year in prison. A separate agreement was also in place, where Biden would agree to a two-year plan similar to probation in exchange for prosecutors dismissing the gun charge, a rarely-charged felony carrying a maximum sentence of ten years.
This diversion plan for the gun charge included immunity for crimes related to both the gun charge itself and the financial matters central to the tax charge.
Judge Noreika raised concerns about various aspects of both plea agreements and the interaction between the tax charge plea and the gun charge diversion plan. She expressed dissatisfaction with both parties wanting her to “rubber stamp” the agreements, leading to extensive questioning and scrutiny of the documents during the hearing.
