Huawei wins a lawsuit against Samsung – Samsung pays around $11.6 Million for patent violation: 

In May 2016, the Chinese Electronics company Huawei Technologies Co.Ltd. sued the South Korean Tech Giant Samsung for violating and infringing its patents in the production of almost 20 of its smartphones. Huawei claimed that the patent of the flagship devices is with them while Samsung used it without permission. The last year’s huge sale of Samsung, the Samsung Galaxy S7, and S7 Edge are Said to be on the list of the infringed patent based devices.

Quanzhou Intermediary Court of China made a judgment in favor of Huawei saying that there is evidence that Samsung is guilty and the tech giant is supposed to pay the Huawei P10 manufacturer 80 million yuan or $11.6 million. The court has ordered the company to stop infringing too.

After the judgment, the Huawei spokesperson said BBC, “Huawei believes that respecting and protecting the intellectual property of others enables all companies to make a return on our R&D investments. We maintain that respect for intellectual property promotes innovation and healthy, sustained growth in the industry.”

It is to note that Huawei filed the lawsuit in several courts in China and the U.S and only one of them have given out this judgment so far. Huawei has said that it has hope and is waiting for the rest of the jury to settle.

Huawei gained these patents on 31 December 2015 after research at the cost of around 59.6 billion yuan. It generated almost 50,377 patents that time, of which Samsung infringed almost 10. Android Authority has said that the amount that Huawei receives is minuscule compared to what Samsung has earned by using the patent. The last year’s revenue of Samsung was near $12.7 billion out of which majority was from the sale of the flagship device S7 and Galaxy S7 Edge. Huawei is getting only $11.3 million which is too small to compare. Still, Huawei is focusing on the remaining lawsuits right now it seems.

Despite the judgment, Samsung is still claiming that there is no violation anywhere and Samsung didn’t use any patent of Huawei. They stick to the point that Samsung is using its own idea in its devices and all the other permissions are legally made.

Samsung reported, “Over many years, Samsung Electronics has pioneered the development of innovative mobile technologies through continuous investment in R&D to provide consumers with a wide selection of innovative products. We will thoroughly review the court’s decision and determine appropriate responses.”
