Now the total amount of payments may exceed $ 1.1 billion
A US judge rejected Apple’s attempt to overturn VirnetX Holding’s patent infringement verdict or reduce the amount of compensation from the current $ 502.8 million. On the contrary, the judge set the number of payments for future violations and the interest rate, as a result of which the total payment to Apple in the two lawsuits could exceed $ 1.1 billion.
Apple again fails to evade compensation for violation of VirnetX patents
In a ruling yesterday, US District Judge Robert Schroeder in Tyler, Texas, denied Apple’s request for a new trial and several other demands.
In particular, Apple’s request argued that VirnetX’s compensation should not exceed $ 113.7 million and that the jury should have advised that the US Patent and Trademark Office found VirnetX’s claims “non-patentable”.
In October, a jury ruled that Apple had infringed two VirnetX patents related to secure networks, known as virtual private networks, that various iPhones and iPads can connect to.
Schroeder also ordered a payment of 84 cents per unit for future violations, which is in line with the jury’s rate. Apple said these payments should be zero or less than 19 cents per unit.
The patent dispute between Apple and VirnetX has been going on for over ten years. Apple paid VirnetX $ 454 million in its first lawsuit last March after the US Supreme Court denied Apple’s appeal. Taking into account the payments under the last decision, the total payment may reach $ 1.116 billion.
