Epic’s doc points out “blatant lies Apple is using to make Epic look bad.”

Since the beginning of the ongoing litigation between Epic Games and Apple, the first have tried to persuade Judge Gonzalez Rogers to admit that Apple’s policies regarding its App Store are illegal. In fact, Epic is pushing for a court to recognize Apple as a monopoly, which takes a huge 30% commission on all game purchases and prevents developers from selling content to players directly for less.

Epic filed a new preliminary injunction motion against Apple on Friday. In the document, Epic points to “blatant lies that Apple has taken to make Epic look bad.” For example, Apple claims Epic has removed the ability to make in-game payments from Fortnite via the App Store. But Epic Games clarifies that this is not true, since the developers have offered players their payment system in parallel with payment through the App Store. And this feature remained in the game until Apple removed it from the App Store.

Apple also said the Aug 13 update has security holes. However, Epic noted that Apple was unable to provide any evidence of these security threats.

According to Epic’s lawyers, Apple’s claim that Epic has taken legal action against it to rekindle declining interest in Fortnite is untrue. Epic clarifies: Apple released information that interest in Fortnite declined 70% from October last year to July 2020. But Apple deliberately chose this time frame, starting in October 2019, when Epic hosted an in-game event that attracted huge attention from players around the world. In fact, during this period, the number of Fortnite users has increased and the popularity of the game has grown.

In a petition, Epic tells the court that it “hopes to demonstrate in court the illegality of Apple’s behavior.”

Earlier, Apple said that  Epic Games orchestrated a covert attack on the App Store, making itself Robin Hood.
