Apple was sued for replacing devices with refurbished devices under warranty, not new ones

This week, law firm Hagens Berman Sobol Shapiro announced that a class action hearing would take place against Apple on August 16 this year, filed back in 2016. The company was accused of providing refurbished rather than new devices as replacements for products returned under warranty.

Apple’s warranty repair terms state that Apple may use new or refurbished parts or products equivalent to new in performance and reliability when servicing a customer’s device. However, the plaintiffs argue that the repaired or remanufactured devices are equivalent to new ones in terms of performance and reliability, and therefore are demanding financial compensation from Apple.

The plaintiff’s group includes US residents who purchased an extended AppleCare + or AppleCare Protection Plan for an iPhone or iPad starting July 20, 2012, and then received a refurbished device to replace their no longer functional one. Apple denies any wrongdoing, but the court will have the final say.
