Apple will make Koss wish it had a lawsuit against wireless headphone makers

Audio engineering and manufacturing company Koss filed a lawsuit against Apple last month, alleging that the California tech giant had infringed five of its patents. Koss claimed that the Beats and AirPods wireless headphones are designed and manufactured with technology stolen from her. But now Apple’s lawyers have prepared a retaliatory strike.

The Apple company, she said, had not infringed any of the five patents listed in Koss’s suit. In addition, it turned out that the headphone manufacturer had no right to sue Apple at all. The Californian tech giant said that representatives from both companies held multiple private meetings in 2017, the content of which is protected by a confidentiality agreement. Under the terms of this agreement, none of the parties should use the information discussed at these meetings for the purpose of legal proceedings. Nevertheless, Apple claims that this is exactly what Koss did, breaking the agreements it concluded three years ago. The most curious thing is that it was Koss who then insisted on signing this agreement, which ultimately turned against her.

Apple has now filed a counterclaim against Koss, which is likely to be dealt with first, as if satisfied, the original claim would be left out.
