Bethesda is sued over the lack of Creation Club in the Fallout 4 season pass

Bethesda Softworks has filed a class-action lawsuit over the release of add-ons for Fallout 4. According to the plaintiff, the season pass should include the Creation Club, which is not there.

In 2015, Bethesda Softworks introduced the Fallout 4 Season Pass and promised access to all of the game’s add-ons. However, in 2017, the company announced the Creation Club, which it described as “a collection of new content for Fallout 4 and The Elder Scrolls V: Skyrim” This content was created by both third-party partners and Bethesda Game Studios itself and is not available to people who purchase the Season Pass.

Class action lawyers Filippo Marchino and Thomas Gray of The X-Law Group argue that the content is DLC and should be available to players who purchase the Season Pass. The lawsuit was filed in July 2019 and included allegations of breach of contract, unjustified enrichment, deceit, and deception. Bethesda Softworks lawyer Margaret Esquenet has denied the allegations.

The lawsuit could delay the deal between Microsoft and ZeniMax Media. At least the class action lawyer is going to ask the court about it.

Fallout 4 is out on PC, Xbox One, and PlayStation 4.
