Yesterday we reported that United States Customs and Border Protection seized about 2,000 fake Apple AirPods, which turned out to be the original OnePlus Buds.

However, instead of admitting a mistake, the US Customs and Border Protection issued a statement saying that the seized headphones infringe on Apple’s trademark.
After examining the shipment in question, our technicians determined that the headphones in question appear to infringe the Apple trademark. Based on this, customs officers at John F. Kennedy Airport confiscated the cargo.
Notably, Apple has not taken any legal action against OnePlus regarding the OnePlus Buds, which were unveiled nearly two months ago. They are still available for purchase in the US and other countries around the world.
The US Customs and Border Protection did not elaborate on why the OnePlus Buds came under the scrutiny of the authorities a couple of months after it went on sale. The market is full of models that directly copy Apple AirPods, and OnePlus Buds clearly cannot be called clones of Apple’s popular headphones.
