TikTok sues the US presidential administration

The Chinese company TikTok on Monday sued the US presidential administration. It is noted that the leadership of TikTok tried to find contact with the American leadership, offered various options for resolving the issue, but the States ignored all legal procedures and tried to intervene in commercial negotiations.

“[President Trump’s] administration has ignored all of our active and conscientious efforts to resolve the issue. We take this lawsuit against the American government very seriously. We simply had no other choice to protect our rights, the rights of our employees, and the rights of our community, ”the company said in a statement.

The lawsuit notes that Trump’s order to ban transactions between TikTok and its parent company, ByteDance, violates legal procedures and is based on an unsubstantiated statement that TikTok poses a threat to US national security. At the same time, the decree does not say what kind of transactions it is talking about.

In a statement, TikTok also points out that Trump has ignored all of the company’s attempts to partner with the US Foreign Investment Committee (CFIUS). This committee is responsible for the legal assessment of company mergers. The committee was engaged in the purchase of the music service Musical.ly by the Chinese company ByteDance, followed by rebranding into the TikTok service in the United States. Trump, by his decree, prohibited this deal and also demanded that the company give up its assets in the United States.

“This decree is not based on a good faith desire to protect national interests,” TikTok said in a statement.

According to TikTok, independent national security experts criticized the politically motivated nature of the presidential decree and questioned whether it truly reflected the goal stated by the US leadership.

Microsoft had previously expressed its interest in buying TikTok and was in talks with ByteDance prior to Trump’s actions that increased pressure on the Chinese company. Last weekend, TikTok confirmed that it is going to sue the US presidential administration for ignoring legal procedures in preparing the decree. Earlier, Trump also signed a decree banning WeChat in the United States, calling the messenger a “serious threat” to national security. Tencent, which owns WeChat, also filed a lawsuit against the decision.
